Terms of Service

These Terms of Service constitute a legally binding agreement between you and Comfyarts governing your use of https://comfyarts.com and the Visual Deconstruction Chrome Extension.
1. Acceptance of Terms
By accessing or using the Service in any manner — including visiting the website, installing the Chrome Extension, creating an account, or purchasing credits — you agree to be bound by these Terms and our Privacy Policy. If you do not agree, discontinue use immediately. We reserve the right to modify these Terms at any time. Material changes will be communicated via notice on the Service or by email. Continued use after changes constitutes acceptance.
2. Eligibility
The Service is for users 18 years of age or older only. By creating an account, you confirm you are at least 18 years old. You must have the full legal capacity to enter into these Terms. Use of the Service must comply with all applicable laws in your jurisdiction.
3. Description of Services
Generate Studio: AI image generation from text prompts. Visual Deconstruction / Replicate Engine: AI analysis of images to generate detailed text prompts — available on both the website and Chrome Extension. The Chrome Extension scans web pages for images at your explicit request and communicates with our secure backend servers. All AI processing occurs server-side. We do not guarantee uninterrupted availability and are not liable for losses from downtime.
4. User Accounts
Accounts are created via Google OAuth. You receive only basic profile access (name, email, picture). You are solely responsible for all activity under your account. You may maintain only one active account. Creating multiple accounts to circumvent credit limitations is prohibited and will result in termination of all associated accounts. Notify us immediately at legal@comfyarts.com of any unauthorized access.
5. Credits and Payments
Credits are a prepaid digital token with no cash value, redeemable exclusively for Service features. New users receive 100 complimentary credits once upon account creation. All credit purchases are final and non-refundable except where required by applicable law. Purchased credits do not expire while your account remains active. Payments are processed exclusively by PayPal — we do not store your payment card details. Initiating a chargeback without first contacting support@comfyarts.com will result in immediate account suspension. Verified technical failures resulting in credit deduction without service delivery may be refunded at our discretion within 7 days of reporting.
6. User Content and Intellectual Property
You retain ownership of all prompts and images you submit or generate. You grant Comfyarts a limited, non-exclusive, royalty-free license to store and process your content solely to provide the Service. You grant us permission to use anonymized, de-identified data to improve our AI systems — we will not use your identifiable content for AI training without explicit opt-in consent. Subject to these Terms, you own generated images and may use them for personal or commercial purposes. Comfyarts retains all rights to the platform, software, designs, trademarks, and brand elements.
7. Prohibited Conduct
You may not use the Service to: generate illegal content or content that promotes violence, terrorism, or illegal activity; generate any content that sexually exploits, depicts, or endangers minors (zero tolerance — violations will be reported to law enforcement); create deepfakes or non-consensual intimate images of real individuals; produce hate content targeting any protected group; reverse engineer or extract source code from the Service; use automated bots to circumvent usage limits; create multiple accounts to obtain free credits; upload images to which you do not hold necessary rights; systematically scrape copyrighted content from third-party websites without authorization. Violations result in immediate permanent account termination with forfeiture of all credits.
8. Chrome Extension Specific Terms
The Extension accesses images on pages you actively browse only when you explicitly click Scan Page Images. It does not monitor your browsing activity or collect data without your direct action. You may only analyze images to which you have lawful access. Use is subject to these Terms and the Google Chrome Web Store Terms of Service. We may update the Extension to add features or address security issues — continued use constitutes acceptance.
9. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT GENERATED CONTENT WILL MEET YOUR EXPECTATIONS OR BE FREE FROM RESEMBLANCE TO EXISTING WORKS. AI-GENERATED CONTENT IS INHERENTLY PROBABILISTIC.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, COMFYARTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID IN THE THREE MONTHS PRECEDING THE CLAIM.
11. Indemnification
You agree to indemnify and hold harmless Comfyarts and its officers, employees, and agents from any claims, damages, and expenses (including legal fees) arising from your use of the Service, your User Content, your violation of these Terms, or your violation of any third-party rights.
12. Termination
You may terminate your account at any time by contacting legal@comfyarts.com — your data will be deleted per our Privacy Policy and unused credits are forfeited. We may suspend or terminate your account without notice for violations of these Terms, fraudulent activity, or conduct harmful to Comfyarts or its users. Credits are non-refundable upon termination for violations.
13. Governing Law and Disputes
These Terms are governed by the laws of India. Any dispute will first be addressed informally by contacting legal@comfyarts.com — we will attempt resolution within 30 days. If informal resolution fails, both parties consent to the exclusive jurisdiction of competent courts in India. Class action participation is waived to the extent permitted by law.
14. General Provisions
These Terms and our Privacy Policy constitute the entire agreement between you and Comfyarts. If any provision is found unenforceable, remaining provisions continue in full effect. Our failure to enforce any right is not a waiver. You may not assign your rights without our prior written consent. We are not liable for delays caused by events beyond our reasonable control.

This Privacy Policy describes how Comfyarts collects, uses, discloses, and safeguards your information when you use https://comfyarts.com and the Visual Deconstruction Chrome Extension. We respect your privacy and never sell your personal data.
1. Information We Collect
Account information: When you sign in with Google OAuth, we receive your name, email address, and profile picture only. We do not access your Gmail, Google Drive, contacts, calendar, or any other Google data. User content: Text prompts you submit, images you upload for analysis, and images you generate. Payment information: Processed exclusively by PayPal — we store only your transaction ID, credit amount, and payment date. We never store card or bank details. Chrome Extension data: Image URLs from the active tab you are browsing (only at your explicit request), your authentication token and preferences stored locally on your device via chrome.storage.local. Technical data: IP address, browser type, device info, and usage logs.
2. How We Use Your Information
To authenticate your identity and provide access to the Service. To process your image generation and prompt extraction requests. To manage your credit balance and process PayPal payments. To detect, prevent, and investigate fraud, abuse, or security incidents. To respond to your support requests. To analyze anonymized, aggregated usage patterns to improve our Service. To comply with applicable laws. We do not use your identifiable prompts, images, or personal data to train AI models without your explicit opt-in consent.
3. Chrome Extension Data Practices
The Visual Deconstruction Chrome Extension accesses images on web pages you actively browse only when you explicitly click Scan Page Images. The Extension does not continuously monitor your browsing, collect your browsing history, read page content without your action, or transmit any data without your direct request. All local storage (auth token, credits, preferences) is stored on your device only and cleared when you sign out or uninstall.
4. Data Sharing and Disclosure
We do not sell, rent, or trade your personal information. We share data only with: PayPal (payment processing), trusted cloud hosting and infrastructure providers (contractually prohibited from using your data for any other purpose), and law enforcement or government authorities when required by law. In the event of a merger or acquisition, we will provide advance notice before your data becomes subject to a different privacy policy.
5. Data Retention
Account data (name, email, picture): deleted within 30 days of account deletion request. Generated content and prompts: retained until you delete them or close your account. Payment records: retained for 7 years for legal compliance. Server logs: retained for a maximum of 90 days. Chrome Extension local data: stored on your device only, cleared on sign-out or uninstall.
6. Data Security
We implement HTTPS/TLS encryption for all data in transit, encrypted storage for sensitive data at rest, strict access controls, and regular security assessments. API credentials are stored exclusively on our secured server — they are never transmitted to or stored in the Chrome Extension. No method of transmission is 100% secure and we cannot guarantee absolute security.
7. Your Rights
You have the right to: access a copy of your personal data; request correction of inaccurate data; request deletion of your data (processed within 30 days); receive your data in a portable format; withdraw consent at any time; object to processing based on legitimate interests. Contact privacy@comfyarts.com to exercise any right. We respond within 30 days.
8. Cookies
Essential session cookies: required to keep you logged in — cannot be disabled without losing Service access. Analytics cookies: used to understand aggregate usage patterns — can be disabled via browser settings. We do not use advertising cookies, cross-site tracking, or fingerprinting technologies.
9. Google OAuth and Third-Party Services
Authentication is performed via Google Sign-In using only the minimum required OAuth scopes: openid, email, and profile. This is governed by Google's Privacy Policy. All PayPal interactions are subject to PayPal's Privacy Policy. We are not responsible for third-party privacy practices.
10. International Data Transfers
Comfyarts stores data on servers located in the United States. By using the Service, you consent to the transfer of your data to the United States or other countries where our providers operate, which may have different data protection laws than your country.
11. Children's Privacy
The Service is for users 18 years and older only. We do not knowingly collect data from anyone under 18. If we become aware of such collection, we will delete it immediately. Contact privacy@comfyarts.com if you believe we hold data about a minor.
12. Changes to This Policy
We may update this policy to reflect changes in our practices or legal requirements. Material changes will be announced on the Service and by email. The "Last Updated" date at the top reflects the most recent revision. Continued use after changes constitutes acceptance.
